Spousal support after a high asset divorce

Spousal support is often granted to lesser earning spouses for a specific amount of time after a marriage is over. This is designed to allow a spouse to enjoy a continuity of lifestyle, as well as provide an opportunity to find employment or settle into a new place. Ohio readers know that not every divorce order will call for spousal support, but courts consider the length of the marriage and other factors when determining if financial support will be given.

Spousal support is an unusual part of the final divorce order between the actor Tom Welling and his wife. Typically, financial support is ordered in a specific amount, but not in this case. Welling is ordered to pay his wife 20 percent of his monthly earnings for the next five years. Anything that he earns over $5 million is not included in that amount.

It is not clear if the couple had a prenuptial agreement, but these are a common practice for wealthy couples or those with valuable assets. It is important to note that a prenuptial agreement can be a wise step for a couple of any income level who is considering marriage. A prenup will typically outline how property will be divided and if any spousal support will be paid to the lesser earning spouse.

For those who are considering marriage, a prenup can provide peace of mind in case of divorce. For Ohio readers who are facing the end of a marriage, a lawyer can explain if it is in his or her best interests to seek spousal support in the divorce order. To better understand options, it is useful to seek a complete case evaluation.
